Sources report that 30-year-old Joseph Alcazar from Fontana has been charged with the murder of a 14-year-old girl, Rosenda Elizabeth Smiley, in Newport Beach, after a suspected drunk driving incident. The tragic event took place on a Wednesday evening near Balboa Boulevard and Palm Street, a block close to the Balboa Fun Zone. The teen was crossing the street on E. Balboa Boulevard with two companions when the incident unfolded. Sources indicate that an oncoming driver had halted their vehicle to allow the pedestrian group to cross the road safely. However, the accused, Alcazar, allegedly chose to circumnavigate the stopped car, driving onward and consequently striking Smiley. He also reportedly ran over the foot of a 13-year-old girl in the process. Emergency responders pronounced Smiley deceased at the scene. It was also found that during the tragically fatal incident, Alcazar had his eight-year-old daughter and another male passenger in his vehicle. Authorities report that Alcazar had a blood alcohol level twice the legal limit at the time of the crash. Alcazar has earlier convictions of two DUI incidents, one of which caused him serious injuries. Alcazar has now been charged on counts of felony murder, felony driving under the influence of alcohol causing grievous bodily harm, misdemeanor count of willful endangerment of a child, and felony driving under the influence of alcohol with a blood alcohol concentration of .08 or higher. If found guilty on all charges, Alcazar would face a punishment of up to 15 years to life, in addition to six years in prison.
